TERMS AND CONDITIONS OF USE Please note that these Terms and Conditions of Use may vary depending on the Collection or Content you are accessing. All members must email and/or mail a copy of their signed Terms and Conditions of Use stating that they have read and agree to all terms prior to receiving access to the database. Once your certification formed is received by BHS your access and pass code will be emailed to you. 2.1 The following statements are made by the Benjamin Harrison Society and the Library of Congress Mapping Division, the institutions from whose collections the materials reproduced here are drawn. (a) The materials digitized for the GIS Historical Maps are drawn from the collections of two repositories · Library of Congress · U.S. Archives · U.S. Navy Museum · U.S. Corps. Of Engineers · David · Benjamin Harrison Society GIS Historical Map Collection (b)The owning institution is identified in the "Repository" field of the description of the item. (c)The Library and Benjamin Harrison Society encourages the use of these materials for educational and scholarly purposes, but any use requires that a credit line be included with each citation. 2.2 Suggested Credit Line: (a) Historical Map Credit Line [Name of Collection],GIS Historical Map Special Collections Benjamin Harrison Society, Washington, D.C. (b) Use of these Benjamin Harrison Society GIS Historical Mapping materials in commercial publication projects require the permission of the Benjamin Harrison Society and is subject to a usage fee. For permission to copy or use any of these materials from the Benjamin Harrison Society for any commercial purposes, please contact the organization at the address given below. ( c) Through the descriptive records in the GIS Historical Maps, the Benjamin Harrison Society is providing information from the Library Congress, Geography and Mapping Division records regarding the authors, publishers, or other persons associated with each item. This information is provided as a service to aid patrons in determining the appropriate use of an item, but that determination ultimately rests with the patron. The Benjamin Harrison Society is unaware of any restriction on copyright in the published materials and appreciates hearing from anyone who may have additional information about any of the items in the GIS Historical Mapping collection. 2.3 Prohibited Uses
(a) Prohibited Uses. Institutions and users may not: 1. Use or authorize the use of BHS for commercial purposes or gains, including charging a fee-for-service for the use of BHS beyond reasonable printing or administrative costs. For purposes of clarification, "commercial purposes or gains" shall not include research whose end-use is commercial in nature.
2. Except as set forth in Sections 2.1 and 2.2, provide and/or authorize access to the BHS Archive or Content available through Individual Access to persons or entities other than Authorized Users; 3. Modify, obscure, or remove any copyright notice or other attribution included in the BHS Archive; 4. Attempt to override, circumvent, or disable any encryption features or software protections employed in BHS; 5. Systematically print out or download Content to stock or replace print holdings; 6. Undertake any activity that may burden BHS's server(s) such as computer programs that automatically download or export Content, commonly known as web robots, spiders, crawlers, wanderers or accelerators; 7. Make any use, display, performance, reproduction, or distribution that exceeds or violates these Terms and Conditions of Use; or 8. Incorporate Content into an unrestricted database or website, except that authors or other Content creators may incorporate their Content into such sites with prior permission from the publisher and other applicable rights holders; 9. Download or print, or attempt to download or print, an entire issue, map, or issues of journals or substantial portions of the entire run of a journal, other than on an isolated basis because of the relevance of the entire contents of a journal issue to a particular research purpose, or substantial portions of series of monographs or manuscripts; or 10. Reproduce or distribute Content in bulk, such as by including Content in course packs, electronic reserves, repositories, or organizational intranets (but see Section 2.3, below).

These copies are provided in accordance with the United States copyright law. Copying is limited to materials in sound physical condition and not subject to legal or donor restrictions. All requests for copies are subject to curatorial approval. (b) Permission to copy does not convey the right to reproduce or publish the material. Readers must submit written requests for permission to reproduce or publish material from the collections. Some publication projects may be subject to a use fee. 1. 2. Shipping and Handling: We are happy to hold your order for pick-up. If you would like to us to ship your order instead, a $10.00 shipping and handling fee will be added to any order under 50 pages. Each subsequent 50 copies will have a $2.00 additional charge added. An additional fee may be charged for orders requiring special handling. 2.6 Photocopy Services
(a) BOUND VOLUMES · Copy limit: 50 pages per bound volume · Letter-sized copies: $.50 each · Legal-sized copies: $1.00 each · Ledger-sized copies: $2.00 (b) ARCHIVAL/UNBOUND MATERIALS · Copy limit: 50 pages per archival box or 150 per record storage carton · Letter-sized copies: $.25 each · Legal-sized copies: $.50 each ( c ) ADDITIONAL FEES · $10.00 service fee per order for remote photocopy requests · Unusually large or complex orders submitted remotely will be subject to an additional set-up fee to be billed at the rate of $20.00 per hour · Minimum of $5.00 mailing fee (e) Each subsequent 50 sheets, add $2.00 to the mailing fee 2.7 Scanning Services (a) File size prohibits us from emailing images to patrons. (b) Digital orders are filled in 3 to 4 weeks. Digital images are sent as TIFF files with a resolution of 300-600 dpi for 8-bit grayscale and for 24-bit color. Digital file orders will be delivered electronically through a File Transfer Service. ( c ) Digital file orders will be burned to CD only upon request, or when a file size is over 100mb; additional service and mailing fees will apply. We are unable to provide custom and rush orders or prints made from scans. (d) Scanning:

RESEARCHER AGREES TO ASSUME FULL RESPONSIBILITY FOR AND AGREES TO DEFEND AND INDEMNIFY THE LIBRARY OF COGRESS, GEOGRAPHY AND MAPPING DIVISION, BENJAMIN HARRISON SOCIETY ITS BOARD OF TRUSTEES, OFFICERS, EMPLOYEES, AND AGENTS AGAINST ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LIABILITIES, COSTS, OR EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING OUT OF OR RELATED TO HIS OR HER USE OF THE GIS HISTORICAL MAPPING SPECIAL COLLECTIONS OF THE BENJAMIN HARRISON SOCIETY. 2.8 Responsibilities of Authorized Users (a) Authorized Users are responsible for maintaining the confidentiality and security of their username and/or password (if such are provided), and for all usage or activity by them of BHS. Except as permitted , Authorized Users may not provide access to BHS to anyone else, including by setting up an anonymous remailer for purposes of allowing access to BHS. (b) Authorized Users promptly shall notify BHS and, where application, their affiliated Institutional Licensee, of any known or suspected unauthorized use(s) of their account or BHS, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure or use of their username, password, and/or IP address. Any use of BHS beyond the scope or in violation of these Terms and Conditions of Use, knowing use of any password or username of another, or any fraudulent, abusive, or otherwise illegal activity, may be grounds for termination of an Authorized User's account, or termination of access to BHS from their IP address, without notice and at BHS's sole discretion. 1. Warranty; Disclaimers 1.1 BHS represents and warrants under the laws of United States that use of the BHS Archive by Authorized Users in accordance with the terms of this Agreement shall not infringe the copyright of any third party. The foregoing shall not apply, however, to modifications or derivative works of the BHS Archive created by Institutional Licensees, Authorized Users or by any third party, nor usage of the BHS Archive by Institutional Licensees or Authorized Users in violation of these Terms and Conditions of Use. Please note that the foregoing further shall not apply to certain Collections. See the Sections below for additional information. 1.2 BHS shall not be liable, and Institutional Licensees and Authorized Users agree that they shall not hold BHS liable for any loss, injury, claim, liability, damages, costs, and/or attorneys fees of any kind that result from the unavailability of the BHS Archive, databases, delays or interruption of the services provided hereunder, or arising out of or in connection with Institutional Licensee's or Authorized Users' use of the BHS Archive in violation of these Terms and Conditions of Use. If the BHS Archive fails to operate in conformance with the terms of this Agreement, Institutional Licensee shall immediately notify BHS, and, subject to all Sections, BHS's sole obligation shall be to repair the nonconformity. In no event shall BHS's liability to an Institutional Licensee exceed the fees paid to BHS by that Institutional Licensee for the term of the agreement then in effect. 1.3 OTHER THAN ANY EXPRESS WARRANTIES STATED IN THIS SECTION , BHS, CONTENT AND ACCESS ARE PROVIDED ON AN "AS IS" BASIS, AND BHS AND ANY AND ALL THIRD PARTY CONTENT AND DATABASE HISTORICAL MAPS PROVIDERS AND/OR LICENSORS ("CONTENT PROVIDERS") DISCLAIM ANY AND ALL OTHER WARRANTIES, CONDITIONS, OR REPRESENTATIONS OF ANY KIND (EXPRESS, IMPLIED, ORAL, OR WRITTEN) RELATING TO BHS, CONTENT, ACCESS SOFTWARE, HISTORICAL MAPS OR ANY PARTS THEREOF, INCLUDING WITHOUT LIMITATION, ANY AND ALL IMPLIED WARRANTIES OF QUALITY, PERFORMANCE, COMPATIBILITY, MERCHANTIBILITY, OR FITNESS FOR A PARTICULAR PURPOSE. BHS AND ALL CONTENT PROVIDERS MAKE NO WARRANTIES WITH RESPECT TO ANY HARM THAT MAY BE CAUSED BY THE TRANSMISSION OF A COMPUTER VIRUS, WORM, TIME BOMB, LOGIC BOMB, OR OTHER SUCH COMPUTER PROGRAM, EXCEPT THAT BHS WILL EXERCISE A REASONABLE LEVEL OF CARE TO PREVENT SUCH OCCURRENCES. BHS AND ALL CONTENT PROVIDERS FURTHER DISCLAIM ANY LIABILITY AND MAKE NO WARRANTIES WITH RESPECT TO ANY ERRORS OR OMISSIONS IN THE CONTENT, LIABILITY UNDER LIBEL LAWS, INFRINGEMENT OF RIGHTS OF PUBLICITY AND PRIVACY, MORAL RIGHTS, OR THE DISCLOSURE IN THE CONTENT OF CONFIDENTIAL INFORMATION AND FURTHER DISCLAIM ANY LIABILITY AND MAKE NO WARRANTY WITH RESPECT TO ANY CLAIMS AND/OR THREATENED CLAIMS (INCLUDING INTELLECTUAL PROPERTY RIGHTS CLAIMS AND/OR THREATENED CLAIMS) RELATING TO: LINKS BETWEEN BHS AND OTHER SITES AND/OR THE CONTENT ON SUCH LINKED SITES; ADAPTATIONS AND/OR MODIFICATIONS OF CONTENT; ANY AND ALL USES, REPRODUCTIONS, DISPLAYS, PERFORMANCES, AND DISTRIBUTIONS THAT EXCEED THE PERMITTED USES (WHETHER PERMITTED BY LAW OR OTHERWISE); AND/OR ANY USE(S), REPRODUCTIONS, DISPLAYS, PERFORMANCES, AND DISTRIBUTIONS MADE OF CONTENT (PRINTED OR EXPORTED) AFTER THE EXPIRATION OR TERMINATION OF THIS AGREEMENT AND/OR THE APPLICABLE INSTITUTIONAL PARTICIPATION AGREEMENT. 2.9 Security We protect your personal information from unauthorized access and disclosure through the use of passwords, physical security measures, managerial measures, and (in connection with credit card information for order sales through the Pay Pal ) encryption. We nonetheless recognize that third parties may obtain access to information through unlawful actions, and thus do not promise that your information always will remain private, despite our efforts and the importance we place on maintaining your privacy. In addition, we do not claim any responsibility for information collected by or from websites linking to or from BHS.
Note: there is a $5.00 fee for all purchase orders. Membership dues are non-refundable.
All members are granted access to use the DOTS/GIS Database. Downloading is not permitting without the written permission of BHS. Members may use the electronic version of historical maps.
